Chers collègues, chers étudiants,
Dans le cadre des activités du Réseau universitaire européen « droit de l’espace de liberté sécurité justice » (GDR-CNRS, n° 3452), mis en place par différents centres et unités[[{"type":"media","view_mode":"media_original","fid":"491","attributes":{"alt":"","class":"media-image","height":"407","width":"334"}}]] de recherches spécialisés en droit européen au sein des Universités d’Aix-Marseille, Lyon, Paris-Nanterre, Pau-Bayonne et Toulouse (coordination scientifique : H. Labayle , R. Mehdi, S. Poillot-Peruzzetto, M. Blanquet, S. Robin-Olivier , I. Omarjee, L. Sinopoli, C. Nourissat, J.-S. Bergé), sont organisés tous les ans ateliers doctoraux européens, consacrés à l’étude de cet espace.
Les deux premières manifestations se sont tenues à l’Université de Toulouse (dir. Pr S. Poillot-Peruzzetto) et à la Faculté pluridisciplinaire de Bayonne (dir. Pr H. Labayle).
Ces ateliers ont l’un et l’autre connu un vif succès, auprès des jeunes chercheurs comme de leurs directeurs. Ils ont rassemblé une vingtaine d’universités françaises et européennes. Les travaux collectifs des doctorants ont fait l’objet d’une publication à la Revue Lamy droit des affaires, en 2010, puis en 2011.
La troisième édition de ces sessions doctorales internationales se tiendra à l’Université Jean Moulin,

Dear colleagues, dear students,
As part of the agenda of their European University Network "Law of the Area of Freedom, Security and Justice” (GDR-CNRS, n° 3452), the universities of Aix-Marseille, Lyon, Paris-Nanterre, Pau-Bayonne and Toulouse (Scientific coordination is supervised by H. Labayle , R. Mehdi, S. Poillot-Peruzzetto, M. Blanquet, S. Robin-Olivier , I. Omarjee, L. Sinopoli, C. Nourissat, and J.-S. Bergé), organize every year a series of European Doctorate Workshops on the understanding of this area, through their research centers specialized in European Law.
The first two meetings took place at the University of Toulouse (dir. Pr S. Poillot-Peruzzetto) and at the multidisciplinary University of Bayonne (dir. Pr H. Labayle).
They both met with success among the doctorate students and their research supervisors, as it gathered more than twenty French and European universities. The result of the doctorate students' collaborative work was published in the Lamy review, Droit des affaires, in a series of 2010-2011 issues.
The third session of these European Doctorate Workshops will take place at the University Jean

l’Équipe de droit international, européen et comparé
(EDIEC, Université Jean Moulin, Lyon 3) et le soutien de
l’Ecole doctorale de droit (EDD - Lyon - St-Etienne).
Dans la continuité des années précédentes, de nombreux
doctorants, post-doctorants, ainsi que leurs directeurs de
recherche, sont attendus, venus de toute l’Europe. La session
entend également associer le monde des professionnels du
droit.
I - Les réflexions porteront cette année sur le thème : « La
fragmentation de l’espace juridique européen de liberté,
sécurité, justice »
L’espace de liberté sécurité et justice, créé à la faveur du
traité d’Amsterdam, a en effet donné naissance à un droit aux
figures originales.
Des figures « géographiques » tout d’abord. Selon les sujets
abordés, les États membres ne participent pas toujours de
façon identique au processus européen. Les avancées de
l’espace de liberté sécurité justice se sont ainsi accompagnées
de disparités spatiales. Des situations dérogatoires, autorisées
par les facultés d’opt in et d’opt out dont bénéficient
plusieurs États membres, le mécanisme de coopération
renforcée ou, encore, la possibilité d’associer des États tiers à
certains actes normatifs, sont autant de processus venant
perturber la détermination des frontières du droit de l’espace
de liberté sécurité justice.
La singularité de cet espace se manifeste encore à travers ses
figures « géométriques ». Les relations entre les différents
acteurs institutionnels varient selon les champs couverts par
l’espace de liberté sécurité justice, ces derniers faisant appel
à des notions très différentes : la coopération, fondée ou non
sur la reconnaissance mutuelle, selon que l’on envisage le
volet civil ou pénal de l’espace, l’élaboration de politiques
communes en matière d’asile, d’immigration et de
franchissement des frontières extérieures, ou encore, à michemin,
la coordination. L’espace de liberté sécurité justice
porte ainsi des approches sensiblement différentes, dans sa
dimension interne comme dans sa dimension externe,
dessinées tantôt de manière verticale, témoignant alors d’une
intégration assumée, tantôt, au contraire, de façon
horizontale.
Son unité doit nécessairement être appréciée à la lumière de
ces différentes méthodes.
II - C’est cette configuration complexe que la troisième
session doctorale internationale se propose d’étudier.
Tandis que la question de l’ « avenir de l’Europe » est
aujourd’hui régulièrement soulevée, dans un contexte de
crises régionales et mondiales, les jeunes chercheurs et
spécialistes de différents horizons européens proposent de se
rencontrer et d’échanger sur ces problématiques.
Le champ des ateliers comprendra essentiellement deux
approches :
Thème 1 : l’espace de sécurité liberté justice à
géographie variable, comment ça marche ?
Une figure originale de l’espace de liberté sécurité
justice peut être identifiée, dans sa structure
matérielle et dans ses procédures décisionnelles.
Les doctorants travailleront sur différents champs
couverts par l’espace de liberté sécurité justice,
comme la coopération judiciaire ou la libre

As previously, many doctorate or post-doctorate Law
students from all over Europe are expected, along with
their supervisors. Practitioners will be in attendance as
well.
I - This year, the following issue will be discussed:
“The Fragmentation of the Area of Freedom, Security
and Justice”
Created by the Amsterdam Treaty, the Area of Freedom,
Security and Justice (AFSJ) has given rise to an original,
multifaceted breed of Law.
First, it is characterised by a “geographical” dispersion:
according to the topic under consideration, Member
States do not take part into the European process the
same way. Thus, the development of the Area of
Freedom, Security and Justice introduced spatial
disparities. Furthermore, some exceptions such as the
opt-in / opt-out faculty granted to several Member States,
enhanced cooperation, the ability to associate other
countries to certain normative acts, etc. represent as many
potential threats to the stabilization of the Area of
Freedom, Security and Justice’s legal contours.
Secondly, this originality of the Area of Freedom,
Security and Justice shows through variety of
“geometrical” figures. The relations between European
institutions vary according to the topic under
consideration. The latter may appeal to different notions:
cooperation - grounded or not grounded under mutual
recognition, depending on whether we treat civil or
criminal matters, - the implementation of common
policies concerning asylum, immigration and the crossing
of the area’s external borders, or, to a lesser scale,
coordination. The Area of Freedom, Security and Justice
develops substantially different approaches, internally
and externally. They fall into two main categories:
vertical approaches, revealing a resolutely integrative
strategy, and horizontal approaches.
Its unity needs to be assessed in light of theses various
methods.
II. - The third International Doctorate Workshops
offers to study this complex configuration. Within a
context of regional and global crisis, the question of the
future of Europe is currently raised. Young researchers
and specialists from different European backgrounds
propose to meet and to discuss these issues.
The workshops will focus on two main themes:
First theme: the Area of Freedom, Security and
Justice in light of its geographical
heterogeneity - how does it work?
The originality of the Area of Freedom,
Security and Justice, can be apprehended
through its material dimension as well as its
decision-making procedures. The doctorate
students will study different fields of the Area

circulation des personnes, et mettront en relation la dimension institutionnelle et substantielle de cet espace. Des réflexions seront menées sur la cohérence des liens identifiés, ainsi que sur leurs conséquences.
Thème 2 : l’espace de sécurité liberté justice à géométrie variable, est-ce possible ?
Les doctorants analyserons l’évolution de l’espace de liberté sécurité justice. Ils envisagerons l’avenir du modèle d’intégration essentiellement économique et envisagerons son application, ou, au contraire, sa non application, à cet espace. Les jeunes chercheurs réfléchiront également aux interactions entre les actions internes et externes menées dans le cadre de l’espace de liberté sécurité justice.
Les thèmes évoqués ne doivent pas être perçus comme des limites fixes à la réflexion, mais davantage comme des guides. Alors que la logique spatiale est au coeur de la démarche des auteurs du traité, les réflexions menées sur la fragmentation de l’espace de liberté sécurité justice permettront de tirer des enseignements de l’expérience acquise au sein de cet espace, afin d’envisager son avenir.
III - Les ateliers doctoraux (jeudi 14 juin après-midi et journée du 15 juin) seront précédés d’une table ronde et d’un débat (matinée du 14 juin), la première comme le second étant animés par des fondateurs ou responsables du réseau Espace de liberté sécurité justice, par des invités ou membres extérieurs du GDR, ainsi que par des professionnels du droit, partenaires du projet. La table ronde visera à porter un regard critique sur l’actualité de l’espace de liberté sécurité justice, tandis que le débat sera mené sur la question de « L’avenir d’une Europe à géométrie variable ».
Le déroulement des ateliers reprendra un schéma semblable à celui retenu lors des deux premières éditions. Encadrés à titre principal par l’un des professeurs du réseau, ils s’appuient sur la compétence des professeurs « ressources », c’est à dire, impliqués dans la recherche doctorale et en provenance de différentes universités européennes et françaises.
Au cours de ces ateliers, les doctorants sélectionnés par un comité scientifique feront brièvement part dans un premier temps (15 minutes en langue française ou anglaise) de leur travail et de l’état de leur réflexion, en liaison avec le thème de l’atelier doctoral. La présentation fera ensuite l’objet de questions et débats, chaque atelier devant répondre par un travail commun aux sujets dont l’étude leur a été confiée. Les échanges menés au sein de chaque atelier donneront lieu à une présentation publique, lors de la séance plénière terminale.
Au-delà de l’exercice de présentation, les doctorants pourront ainsi se confronter au débat et rencontrer des collègues de leur génération travaillant sur des questions voisines. Cette session doctorale internationale sera également l’occasion, pour les directeurs de recherche, de se rencontrer et d’échanger.
La publication des résultats des différents ateliers permettra enfin de mettre ce travail à disposition de la communauté scientifique.
of Freedom, Security and Justice, such as judicial cooperation or freedom of movement of people. They will link the institutional aspects of this space with its substantial dimension. Discussions will be conducted on the consistency and consequences of the connections identified.
Second theme: the Area of Freedom, Security and Justice in light of its variable geometry - is it possible?
The doctorate students will analyse the evolution of the Area of Freedom, Security and Justice. They will consider the future of the integration model, mainly based on economic purposes. They will think of its applicability or, on the contrary, of its inapplicability to this area. The young researchers will also examine the interactions between internal and external actions carried out in the Area of Freedom, Security and Justice.
Those general terms should not be regarded as fixed limits to the exchanges. They should rather be seen as guidelines. The approach of the Treaty’s authors is deeply grounded on a spatial logic. Discussions held about the Fragmentation of the Area of Freedom, Security and Justice will help specialists and researchers draw conclusions from the experience gained since the creation of the Area, and think about its future.
III - The workshops (on Thursday, June 14th, during the afternoon and on Friday 15th, all day long), will be preceded by a round table and a debate (on the 14th, in the morning). They will both be led by founders or persons in charge of the Research activities in the Area of Freedom, Security and Justice network, but also by guests or external members of the GDR (Research Group), and by Law practitioners and projects partners. A critical look about the current state of the Area of Freedom, Security and Justice will be adopted during the morning conversation. The debate will turn on “The Future of a Europe with a variable geometry”.
The sequence of these workshops will follow the same rules as previously, as it perfectly lived up to the expectations during the first two sessions. Led mainly by a Professor of the network, they will rely on the competence of the professors involved in doctoral research and coming from various European and French universities. During these workshops, the students - selected by a scientific committee - will first briefly present their work and thoughts (15 minutes in French or English), in accordance with the theme of the doctoral workshop. Presentations will be followed by questions and debates, in order to confront the doctorate student - beyond the exercise of presentation - to debates. The exchanges’ results of the workshops will be presented in public during the plenary terminal session.
These workshops will provide the students with an opportunity to meet colleagues of their generation and working on similar issues, and the research supervisors to meet and exchange. The results of all the Doctorate Workshops will be published in order to inform a larger community of the orientations and progress of the research.

IV - D’un point de vue logistique, les organisateurs de la session doctorale prendront en charge l’ensemble des repas des doctorants et de leurs directeurs de thèse, ainsi que l’organisation sur place des deux journées. Les Centres de recherche des universités participantes ou leurs Écoles doctorales prendront en charge le voyage et l’hébergement à Lyon de leurs chercheurs et enseignants.
